Texas Trespass Bill To Make Illegal’s Presence State Crime

HOUSTON – State Representative Debbie Riddle (R – District 150) will again file a bill that allows state and local law enforcement officers to arrest those who are in the country illegally.
Last session, Riddle filed House Bill 49, which would have created a new criminal violation: Criminal Trespass by Illegal Aliens. She says she will introduce the same measure during the pre-filing period in November that precedes the new Texas legislative session in January.
“Despite all the national controversy, this is a common sense bill, pure and simple,” Riddle said. “It does nothing but allow law enforcement to do their job: arrest those who are breaking the law.”
Unlike a similar act passed recently in Arizona, Riddle’s bill requires law enforcement to confirm the immigration status of a suspect with US Customs and Immigration Enforcement before making an arrest and does not require the suspect to produce identification. Under the language of HB 49, an officer would have to have reasonable suspicion that the person was present in the country illegally before making the inquiry.
Riddle said she believes the legislature will pass the bill in the upcoming session.
“Nothing less than our national security is at stake when it comes to illegal immigration,” Riddle said. “With the violence escalating along the border, the rest of the state and country has suddenly awakened to a reality that my district has known all along: the safety and security of our citizens is in jeopardy and will continue to be in jeopardy until we secure our border.”

I don’t think people should come here illegal but the process to come here is so long and pricey that i understand why they do what they do. Instead of making so many laws about how to racially profile hispanic people maybe the state can work on the process of becoming citizens. more legal working citizens means more taxes for our conutry.
I find all those people that appose this bill to be comical. The laws have been around for years at the federal level. The individual states are growing tired of the federal branches failing. So, the states are taking it into their own hands. It would also seam that the only people being brought up are from the country just to our south. This is a sensible approach to limiting ILLEGAL Immigration of Mexican nationals, or OTMs. The big problem is CRIME. Arizona is fighting to protect the lives of AMERICAN CITIZENS. We have laws,now let’s enforce them. Check immigration status for all CRIMINALS. Deport criminal illegal aliens and make our street safe again for all Texans. I am a native Texan and although I do not live in her district I fully support Debbie Riddle. I can no longer support Rick Perry as long as he oppose such a bill because he does not truly represent the citizens of Texas. It has been many years since I voted for a Democratic candidate but that’s about to change. There are entirely too many sanctuary cities in the State of Texas and Rick Perry just as much stated that he intends for Texas to be a sanctuary state. Sanctuary cities only encourage illegal immigration! People that oppose such a law show no respect for our laws just the same as the illegals do. They are part of the problem and can never be part of the solution.

Where was ICE during the protests over the weekend. According to thier website…”ICE’s mission is to protect the security of the American people and homeland by vigilantly enforcing the nation’s immigration and customs laws. ” This federal agency has 19,000 employees (paid for by tax dollars). If the ICE employees are unwilling to carryout thier mission they should be fired. If the agency is unwilling to carryout its mission it should be abolished.

It is a crying shame that people who can’t argue the facts have to resort to crying racism. They see racism in everything. America is our Home, we are an open and inviting people, but sneaking in the back door is wrong. I know several immigrants from around the world who have come here LEGALLY. They have filled out the paperwok, paid thier fees, and complied with the law. They are Mexican, Hindu, Asian, and European and none of them consder obeying the law Racisim, and carry thier papers and are not afraid to show them. We put out the welcome mat to world, but illegals wipe thier feet on our laws and our hospitality. We must enforce the laws or soon no one will respect any of our laws. I found Debbie Riddle and I want to give an enthusiastic “yes” to her proposal to curb illegals’ presence in this country. I wish I was in the Legislature so I could be a part of the voters who vote for this legislation. I hear 1/3 of them are Mexican decent sooooo that means 1/3 of you need to drop the identification of your heritage as superior and invoking racism in the light of what’s really happening in the language of this Bill. Can anyone of Mexican decent really read this objectively and without prejudice towards themselves as not being racially discriminated against? There is no such language and its not even implied. It is the over offendability of Mexican people to read discrimination into it and take up the mantle of martyr in the public eye. I have to carry two forms of ID and if a legal Mexican American has to answer to a police officer and show his green card then why are you any different than my needing to show my ID as well? The only difference is those of whom ARE illegal. And that means those of you who are already American citizens by legal immigration or birth then you have to come up to the American standard of law instead of going down to the Mexican substandard of lawlessness. There needs to be a wall and there needs to be documentation and this is just the beginning of what must be even more tighter borders. I honestly agree with Representative Riddle that we need this bill. Honestly if you are in this country and up to no good, then you need to leave. My grandparents came from Mexico legally, learned english and opened up their own business in San Antonio for 27 years. My Grandfather even served as a Medic in the US Army. So if someone truly wants to make a better life for themselves and their family there is a way to do so. For example our cleaning lady now owns her own business, has been taking english and computer classes and doesn’t need goverment assistance. Another thing I wish would be looked at more closely would be the rise of illegal immigrants being provided government assistance. I’ve worked at a local grocer and checked out so many people paying with food stamps and wic that you could tell were not here legally. So why use out tax $ where it can be used somewhere more important. I did see someone post before of freedom of speech but that only really is valid for legal citizens of the US. I’m strictly against illegal immigration but I think the immigration laws and so complicated that it’s hard for most people. I came to US legally on my student visa. I have excellent education and entry level experience but the employers don’t want to sponsor me a work authorization because its expensive and involves lots of documentation. I cannot work off campus and am not able to find on campus job for the summer as most offices are closed. I’m stuck.
I here people saying that their European ancestors came legally 50 , 70 or 100 years ago. Back in those days, the immigration laws were not the same as today’s. Most of the immigrants in those days arrived at Ellis Island and they had to go through a medical check, documents from home country stating their identity, criminal records etc. Then they were free to go anywhere in US and become US citizen easily. Most of the immigrants from Europe were refugees and asylum seekers. They left Europe due to many reasons like famines, economic hardship, political reasons and many others.
The economic and cultural survival of the United States depends upon the clarification and proper enforcement of the 14th amendment, especially in regard to ending automatic citizenship of children of temporary sojourners and visitors (esp. illegal) to this country. In 1866, several of the authors of the amendment clearly stated that the intent was NOT to give citizenship to children of temporary visitors, but only to those children who’s parents themselves had gone through the process of becoming citizens. This intent needs to be clearly spelled out and made law. Otherwise, in 20 years (or less) the US economy and way of life will no longer be sustainable.
I am sick and tired off people saying ilegals get benefits from the USA when the first thing you are asked for is SSN. I was molested by an anglo as a child but at the moment was not yet a citizen and the man said he would call ICE to take my family and I. Not even my family knows about this to this day. No but ilegals are the rapist right???? Chicanos, anglos and blacks are the ones using stamps and wellfare. Ilegals do pay taxes. I know for a fact they can buy homes, that requires taxes be paid. The cruelest thing United States ever did to the Mexican people was after winning the Mexican-American War in 1848, was that we returning Mexico to the corrupt Mexican government. This has become today’s problem. I believe if Mexico would allow private ownership of real estate by citizens of other countries, then their country would prosper and lessen the need for illegal immigration in to The United States.

Ms. Riddle has my prayers and support for her proposal. Anything we can do to stop the invasion is a plus. We not only have illegals to fight, we must beg our own government to enforce the laws. We are NOT a nation of laws, since the first illegal alien was allowed to stay.
What everyone needs to realize is what doesn’t help our US citizens in this economy is when the illegal immigrants take work and sometimes business away from the hard working legal American people. In saying that, I can see right now why certain business establishments are hurting and how they must be effected at this most difficult time by when I see some illegal immigrants creating work on the side that takes away business from others that could very well be potential customers for those who actually own, or are running a real legitimate business.
You need to be a legal resident or an American citizen to collect public assistance. Consequently, no illegal alien can be drawing from the taxes of so call respectable American citizens. Furthermore, the so called illegal aliens are contributing by the millions to the economy to this country, they are hard workers, raise your kids, clean your houses, do your lawn, build your houses & buildings, cook you food, wash your dishes and more.
And the majority are brown skin citizens of this country who are being in America further longer that your ancestors who came from accross the ocean from other parts of the world. If any illegal immigrants are falsely receiving benefits it is because they have lied and cheated the system in order to get ahead. For every unlawful act they commit we Americans have to pay for their wrongful doings.

I agree with passing the Immigration Bill for Texas. I am not prejudiced, but it is unfair for United States citizens for any illegal immigrants to come into the United States and to receive services, including social security and other benefits, that Americans work so hard for. I do not believe that the purpose of immigration law is to cause segregation, as those asked for proof of citizenship are as a result of suspicious illegal activity or violation of traffic laws which requires officers to request proof of citizenship. Perhaps all officers should be required to request proof of citizenship from all persons who appear to be of a nationality other than an American. However, there have been serious problems with illegal immigration from Mexico, and that is undisputable. It has caused other serious problems, including death and drug problems. It is a common sense, no nonsense, law!

if only the government would arrest the rich people or buissiness , who hire illegal immigrants for cheap labor, then recieve tax breaks, while we , the people pay taxes that feed , house and provide for these illegal immigrants. It doesn”t matter where they are from or what the color of their skin. why is it that the statement, we are a nation of laws, being continually uttered by the president , politicians, etc. doesn”t apply to law breakers/ illegal immigrants? what part of that picture, is not being developed. While we , the people work and worry every day about the survival of our families, relatives and freinds, illegal immigrants are being afforded the rights to this ( pursuit of happiness,) , that our taxes are paying for, (not by choice).Not only that, but illegal immigrants are being afforded the right to demonstrate against which ever of our country , or states laws they choose, which goes against the citizens of same said countrys , constitutional , rights. We demand, that our president and leaders , start representing the constitutional rights and laws, of the u.s. or be considered, TRAITORS)!!!!
What works in theory doesn’t always work in practice. Logistically, it’s asking for much. For one, it will tie officers down in wait time. Secondly, it will inevitably lead to cases of racial profiling. Thirdly, it will discourage many from reporting crimes.
What type of offense would this trespassing be, anyway? High misdemeanor? Low felony? If they’re charged with a state crime, not every prosecutor in the state is going to drop the charge. That means that violators would be prosecuted and convicted. That means they will have to spend sentences in county or state jails, costing the taxpayers millions.
On the other hand, if Texas has a policy to not pursue the prosecution, then it’s a straw state law. -A de facto state policy.
I didn’t even mention the possible civil rights violations. An state law enforcement officer has no right to detain someone if they’ve broken no law. A suspicion of a commission of this violation on mere clothes, skin color, accent and lack of I.D. is not enough probable cause to detain someone indefinitely (or until ICE or Customs are contacted and verifications are confirmed).
What if I’m darker in complexion, speak with an accent and am wearing a ball cap with the flag of Italy emblazoned on it. I’m riding passenger on a roadtrip. The driver is pulled over for a ticket. I’m asked for my ID but I seem to have forgotten it on the table back at the Denny’s two towns back. Just how long will DPS be able to legally detain me there? I’ve broken no law. What if INS officials can’t respond for a couple of hours? Is the officer supposed to sit there and babysit me when he could be patrolling the highway looking for drug loads? What about my civil liberties? This kind of stuff happens much more often than you think. -Tens of times daily. Multiply that by the relative size of the state and you got potential lawsuits happening DAILY.
If Rick Perry is opposed to this, I wouldn’t be surprised.

You state, “Most importantly, HB 49 as it was drafted last session did not require anyone to prove their citizenship or risk arrest. An arrest would only be possible once an officer had confirmed with Immigrations and Customs Enforcement that a suspect was an alien who had entered the country illegally. Therefore, HB 49 does not allow for the possibility that legal residents or citizens could be subject to arrest, which was a primary concern in Judge Bolton’s ruling on SB 1070. ”
With all due respect, just how long would a “reasonable” detainment be? After all, the officer still has to detain one for an unspecified amount of time, -all dependent on federal officer’s response time. It has the potential for illegal detainment, which is just as costly as an illegal arrest.
As is, if a law enforcement officer pulls one over for a traffic violation and requests to search the vehicle, one can respectfully decline. By law, it’s a citizen’s right not to submit or comply with an unreasonable search. Now that officer has a choice to detain that person for a canine unit to inspect the exterior of the vehicle. All of it is dependent on “reasonable” detainment. If you are not able to get a canine unit there within reasonable time, you can not keep that person detained for too long. That driver can reasonably start to object in 15 to 20 minutes time.
What if an officer is gung-ho and tries to detain someone for an unreasonable amount of time based on their clothes, haircut, accent, etc.? That municipality would have to pay out on lawsuits for unlawful detainment. If it’s a DPS violation, then the state would incur the costs of civil rights violations. A shrew lawyer would file on both county and state. Illegally detaining someone IS IN FACT holding them “subject to arrest.”
What about all those fine state law enforcement officers having to worry about crossing the lines of The Texas State Legislature’s Code Of Criminal Procedure Section 1, Chapter 2, Articles 2.131 through 2.138 on Racial Profiling in Texas? Are these officers expected to do a balancing act on what could cost them their jobs and cost them personally and civilly?
An officer can be held personally responsible for an infraction. They risk personal lawsuits. No one is even considering the fine men and women of law enforcement. Madam Representative, there are the many facets of this law that have probably gone unconsidered. I think all the factors should be weighed. We all want to do something about the immigration problem.
Get your head out of the sand! The law clearly states you are here legally or illegally. Short sweet and simple! It is the law the have identification on you. It is the law to have auto insurance. It is the law to document all workers whether you are a large corporation or a small farmer. All residences have a responsibility to be counted when it comes to the census. If you are not counted this is tax dollars that Texas does not received from the govenment. It goes elsewhere! When I travel abroad…since I am not a citizen I must carry identification with me at all times. I get double checked when I go in and out of Mexico. Why should it be any different here. If you want to live here….learn to speak and write the english language. Go get a job and prove you are working and give back to the community. Volunteer somewhere if you are not working! You want to live here and get the many benefits….become a U.S. Citizen and go through the legal process just like families from India, Pakistan, China, Russia, etc. etc. etc.etc, etc. No matter where you migrate from….we appreciate the fact you want to be here….but do the right thing and go through the process just like everyone else. Abide by the laws!
