Texas Trespass Bill To Make Illegal’s Presence State Crime

HOUSTON – State Representative Debbie Riddle (R – District 150) will again file a bill that allows state and local law enforcement officers to arrest those who are in the country illegally.

Last session, Riddle filed House Bill 49, which would have created a new criminal violation: Criminal Trespass by Illegal Aliens. She says she will introduce the same measure during the pre-filing period in November that precedes the new Texas legislative session in January.

“Despite all the national controversy, this is a common sense bill, pure and simple,” Riddle said. “It does nothing but allow law enforcement to do their job: arrest those who are breaking the law.”

Unlike a similar act passed recently in Arizona, Riddle’s bill requires law enforcement to confirm the immigration status of a suspect with US Customs and Immigration Enforcement before making an arrest and does not require the suspect to produce identification. Under the language of HB 49, an officer would have to have reasonable suspicion that the person was present in the country illegally before making the inquiry.

Riddle said she believes the legislature will pass the bill in the upcoming session.

“Nothing less than our national security is at stake when it comes to illegal immigration,” Riddle said. “With the violence escalating along the border, the rest of the state and country has suddenly awakened to a reality that my district has known all along: the safety and security of our citizens is in jeopardy and will continue to be in jeopardy until we secure our border.”

    If you travel to Mexico, Canada, France, Costa Rica etc and are stopped by police for any reason whatsoever, and you do not have a US Passport showing that you are a legitimate visitor, they detain/arrest you. And unless you can resolve it quickly, you are deported. This is long overdue and much-needed legislation, press on as you have all of our support.

    I own a small construction business in Farmers Branch Texas, before I learned how to check to make sure my workers were legal through the Social Security office I had a few illegals with fake documentation working for me. I found that they did not marry their so called “wives” which allowed their illegal wives and anchor babies to receive a multitude of benefits from our government benefits I can’t get as a legal resident. I applaud you for your efforts to stem the tide of these people who come here and rape our society. I had one illegal steal approx. $20,000 worth of materials from me and the local police did nothing. I had two run into my car, they had no papers and nothing was done to them. They stole my insurance cards from my trucks and gave my information to goodness knows how many other illegals to put in their vehicles. If I were in your district I would support you in any election, we need more people like you in public office. Also, I am furious that illegals can get in state tuition benefits, where is the logic here? If my grandson wanted to come here to a Texas university he would not have that benefit??? This country is headed for a disaster if something isn’t done immediately.

    Thank You for this attempt to stand up for the citizens of the U.S.A. As someone who has lived within 20 miles of the southern border my whole life, I have seen the affects of illegal immigration first hand. There are approx. 20 illegals living in a canyon about 2 miles from my house. The local authourities do nothing. Trash, defecation, illegal fires and lower wages are all immediate affects. Someone must do something!

    Thank you for being an heroic American and proud Texan by introducing this bill. It’s about time we did away with the sancutuary city policies and gave our police the tools they need to do their jobs.
    My brother is a Harris County constable and, due to the lack of enforcement of the federal immigration policy, when he stops someone for a crime and discovers their status is illegal, he has no choice but to let them go. He has no county, city or state laws that allow him to arrest the alien for the crime of being here illegally. He has to either wait for Federal agents (could take hours or days) or let the alien go. This law does not hurt anyone’s civil rights, it simply allows the police to ask for identification from a person who is suspected already of committing a crime. Why are so many afraid to call the act of being in this country illegally a crime? If it weren’t a crime, it wouldn’t be classified as illegal!

I totally agree with your bill and I hope the best for the Arizona Gov. also. Why is the Federal Government thinking the States do not have rights to enforce a Federal law of Illegal Immigration. If you are here illegally you are breaking the law. Same as any other country in the World.

    I want to thank you for proposing the “AZ Immigration law” here in Texas. There has been a long time need for this in order to support the constitutional rights of American citizens and the nation at large. I hope also that the state can get the Federal govt to enforce the laws they have ignored or under enforced for years whether through complacency or wink and nod politics.

    At a time our nation has record unemployment, and an administration issuing job killing legislation, the United States does not need any additional surplus workers. We can’t afford this charity anymore with soaring budget deficits.

    It boggles me that we have laws and do not enforce them, and as a result enact more laws. It’s wonderful to see the state doing something about enforcing the law instead of pandering to a quick fix of rewarding criminal behavior and penalizing those who choose to follow the law.

    I will be watching this legislation.

    I just read the proposed bill and it is short and very easy to understand. As a thinking person, it appears that this law is a common sense addition made necessary by the complacency of our citizens. As a citizen, I realize that it is often easier to look the other way when we see unethical/illegal activity if our families are not directly impacted. As an attorney, I understand law enforcement as a punishment, as a protection and as a deterrent is necessary for a healthy and responsible society. The impact of this law on mixed families (citizens and trespassers) is going to be very emotional and an unpleasant event. In conclusion, citizen complacency has resulted in gross failure of our system. Sometimes, tough love is as necessary in communities as it in families. Hang in there! We’re with you and you are in our prayers.

    Back during The Great Depression, President Herbert Hoover ordered the
    deportation of ALL illegal aliens in order to make jobs available to American
    citizens that desperately needed work..

    Harry Truman deported over two million Illegal’s after WWII to create jobs for returning veterans.

    And then again in 1954, President Dwight Eisenhower deported 13 million
    Mexican Nationals! The program was called ‘Operation Wetback’. It was
    done so WWII and Korean Veterans would have a better chance at jobs.
    It took 2 Years, but they deported them!

    Now…if they could deport the illegal’s back then – they could sure do it today.

I take my cowboy hat off to you, and btw, I am questioning any and all employers that deal with labor workers on how they pay the workers. So far all they will say is by check when asked Payroll check, no answer. Maybe we need to start chasing down the way businesses are writing so many business checks out to CASH.

We are only stating there are rules to follow to become citizens, and we expect rules to be followed. We have to show proof of citizenship to even sign up kids for school, why should they not have to show proof of i.d.

    I support your efforts 100%. There is no profiling in the bill. Keep in mind the people we are talking about have already demostrated they dont care about our laws. If this causes them a hardship I suggest they go back to the paradise the came from and protest to the Mexican goverment about rights and being fair. When we start picking which laws to enforce then all are subject to no being enfoced. The comment made earlier about the federal goverment being in charge obviously lives in a cloud.
